PREMIUM CAR RENTAL AGREEMENT

1. Parties and Agreement Date

This Premium Car Rental Agreement (the "Agreement") is made and entered into as of _______ (the "Effective Date"), by and between: The Lessor:
_______, a(n) _______ with a primary address at _______ ("Lessor"). AND Lessor and Lessee are individually referred to as a "Party" and collectively as the "Parties".

2. Recitals

WHEREAS, Lessor is the legal owner of the premium motor vehicle described herein (the "Vehicle");
WHEREAS, Lessee desires to rent the Vehicle from Lessor for a temporary period upon the terms and conditions set forth in this Agreement;
NOW, THEREFORE, in consideration of the mutual covenants and promises contained herein, the Parties agree as follows:

3. The Vehicle

Lessor hereby agrees to rent to Lessee, and Lessee agrees to rent from Lessor, the following described motor vehicle (the "Vehicle"):

4. Rental Period and Locations

The term of this rental (the "Rental Period") shall commence on _______ at _______ (the "Pickup Time") and shall terminate on _______ at _______ (the "Return Time").

The Vehicle shall be picked up by the Lessee at: _______ ("Pickup Location").

The Vehicle shall be returned by the Lessee to: _______ ("Return Location").

Any extension of the Rental Period must be agreed upon in writing by the Lessor and may be subject to different rates.

5. Financial Terms

Lessee agrees to pay Lessor the following fees and charges for the rental of the Vehicle:

Taxes: All applicable federal, state, and local taxes, surcharges, and fees will be added to the total rental charges.
Payment: All payments shall be made via _______. The Lessee hereby authorizes the Lessor to charge the provided payment method for all amounts due under this Agreement, including but not limited to, rental charges, fees, fines, penalties, and damages.

6. Security Deposit

The Security Deposit of USD {QID51} shall be held by the Lessor as security for the performance of Lessee's obligations under this Agreement. Lessor may use the Security Deposit to cover any amounts due, including but not limited to, unpaid rental charges, damages to the Vehicle, fines, towing charges, or cleaning fees. The balance of the Security Deposit, if any, shall be returned to the Lessee within 14 business days following the return of the Vehicle, provided the Vehicle is returned in accordance with the terms herein. Deductions from the Security Deposit will be itemized in a written statement to the Lessee.

7. Authorized Use and Drivers

Authorized Drivers: The Vehicle may only be operated by the Lessee(s) named in this Agreement and the following pre-approved additional drivers ("Authorized Drivers"), provided they are at least 25 years of age and possess a valid driver's license: Geographic Limitations: _______ Prohibited Uses: The Vehicle shall not, under any circumstances, be used for any of the following purposes:

• By anyone other than an Authorized Driver.
• For any illegal purpose or in connection with any illegal activity.
• For racing, performance testing, driver training, or any type of competition.
• To tow or push anything.
• For operation on unpaved roads or off-road conditions.
• To transport persons or property for hire.
• While the operator is under the influence of alcohol or narcotics.
• Outside the geographic limitations specified above.

Violation of this section constitutes a material breach of this Agreement.

8. Vehicle Condition and Return

Vehicle Condition: Lessee acknowledges receipt of the Vehicle in good, safe, and serviceable condition, free of any apparent defects, except as noted in a separate Vehicle Condition Report signed by both Parties at the time of pickup. Lessee agrees to maintain the Vehicle in this condition during the Rental Period.

Return of Vehicle: Lessee shall return the Vehicle to the Return Location on or before the Return Time in the same condition as received, ordinary wear and tear excepted. Failure to return the Vehicle by the Return Time may result in additional charges at a rate of 1.5 times the pro-rated daily rental rate.

Fuel Policy: The fuel policy is '_______'. If the Vehicle is not returned with the required amount of fuel, Lessee will be charged for the missing fuel at a premium rate set by the Lessor, plus a refueling service charge.

Cleaning: Lessee shall return the Vehicle in a clean condition. If the Vehicle is returned in an excessively dirty state, as determined by the Lessor in its sole discretion, a cleaning fee will be assessed.

9. Insurance

Lessee's Primary Insurance: Lessee warrants that they carry a valid automobile insurance policy that provides liability, collision, and comprehensive coverage, and that this coverage is primary for any claim arising from the use of the Vehicle. Lessee's insurance details are:

Lessee agrees to provide proof of insurance to Lessor upon request and is responsible for any and all deductibles.

Lessor's Insurance: Lessor provides liability insurance coverage for the Vehicle only as required by the financial responsibility laws of the state of {QID2}. This coverage is secondary to any other applicable insurance.

Optional Coverages: The Lessee has made the following elections regarding optional coverages offered by the Lessor:

• Collision/Loss Damage Waiver (CDW/LDW): Lessee _______ the optional CDW/LDW. If accepted, subject to the terms and exclusions of the CDW/LDW addendum, Lessor waives its right to collect from Lessee for physical damage to or loss of the Vehicle. If declined, Lessee is financially responsible for all damage to or loss of the Vehicle, regardless of fault, up to its full actual cash value.
• Supplemental Liability Insurance (SLI): Lessee _______ the optional SLI. If accepted, SLI provides additional liability protection. If declined, Lessee's financial responsibility for third-party claims is limited only by their personal insurance policy and applicable law.

12. Data Protection and Telematics

GPS Tracking: The Vehicle is equipped with a telematics and GPS tracking device. Lessee acknowledges and agrees that the Lessor may use this device to track the Vehicle's location, speed, and other operational data. This data may be used for purposes including, but not limited to, locating a stolen or overdue Vehicle, providing roadside assistance, and investigating a breach of this Agreement. Lessee's selection confirms: _______.

Personal Data: Lessor will collect and process personal data provided by the Lessee for the purpose of fulfilling this Agreement. This data will be handled in accordance with applicable privacy laws and the Lessor's privacy policy, a copy of which is available upon request.

13. Dispute Resolution

14. Governing Law and Jurisdiction

This Agreement and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the State of {QID2}, without regard to its conflict of law principles.

15. General Provisions

Entire Agreement: This Agreement, including any addenda, constitutes the entire agreement between the Parties and supersedes all prior discussions, agreements, or understandings of any kind.

Notices: All notices required or permitted under this Agreement shall be in writing and shall be deemed delivered when delivered in person, by courier, or by registered or certified mail, or by email to the addresses specified in Section 1.

Severability: If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

No Waiver: The failure of either Party to enforce any provision of this Agreement shall not be construed as a waiver of that provision or of the right to enforce it at a later time.

Counterparts: This Agreement may be executed in counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument. Electronic signatures shall be considered as valid and binding as original signatures.
